SwiftyKafka — Terms of Service / End User License Agreement

By downloading, installing, or using SwiftyKafka ("the App"), you agree to these Terms of Service ("Terms"). If you do not agree, do not install or use the App.

1. Parties

These Terms form a binding agreement between SwiftyTool ("we", "us", "our") and you, the individual or legal entity using the App.

2. License grant

We grant you a non-exclusive, non-transferable, non-sublicensable, perpetual, world-wide license to install and use the App on any Mac that you personally own or control, for either personal or internal business purposes. SwiftyKafka is currently distributed free of charge during early access; if a paid edition (e.g. "SwiftyKafka Max") is introduced in the future, those terms will be presented separately at the point of purchase or subscription, and a fair upgrade path will be offered to existing users.

A single user is expected to install the App only on Macs they themselves own or control. Redistribution to third parties is not permitted (see Section 3).

3. What you may not do

You agree not to:

  • Resell, sublicense, lease, rent, or distribute the App or any future license key to any third party
  • Reverse-engineer, decompile, or disassemble the App, except to the extent that such activity is expressly permitted by applicable law
  • Remove or modify any copyright, trademark, or other proprietary notice
  • Use the App in any way that violates applicable law
  • Use the App to access, monitor, or modify any Kafka cluster (or any other system) you are not authorised to operate

4. Updates

We may from time to time release updates that fix bugs, improve performance, or add features. Free minor and patch updates (e.g. 1.0 → 1.x) are included with your license. Major version upgrades (e.g. 1.x → 2.0), and any future paid tiers, may require a separate purchase or subscription at our discretion; if so, you will be notified before installing such an upgrade.

We are not obligated to maintain backward compatibility with older macOS releases indefinitely.

5. Refunds

SwiftyKafka is currently distributed free of charge, so refunds are not applicable.

If a paid edition is introduced in the future:

  • For Apple StoreKit subscriptions, refund requests are handled exclusively by Apple under the standard App Store / StoreKit refund process.
  • For purchases through Paddle, Lemon Squeezy, Gumroad or another third-party payment provider, that provider's refund policy will apply, and the policy will be summarised on our pricing page at that time.

6. The App connects to Kafka clusters

You acknowledge that the core function of the App is to connect to Apache Kafka® clusters, Schema Registries and KSQL endpoints that you configure, and to perform read and write operations against them on your behalf. You are solely responsible for:

  • Ensuring you are authorised to access and modify the clusters and topics you connect to
  • The content of any messages you produce
  • Any operational impact (e.g. resetting consumer offsets, deleting topics or groups, altering broker configs, deleting schemas, modifying ACLs) that the App performs at your direction
  • Compliance with the terms of service of any managed Kafka provider (Confluent, AWS MSK, Aiven, etc.) you connect the App to

The App provides confirmation prompts for destructive operations, but ultimate responsibility lies with the operator.

7. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL MEET YOUR REQUIREMENTS, OPERATE WITHOUT INTERRUPTION, OR BE ERROR-FREE.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE LICENSE (OR SUBSCRIPTION) DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

9. Termination

These Terms remain in effect until terminated. We may terminate or suspend your license immediately, without prior notice, if you materially breach these Terms. Upon termination, you must cease all use of the App and delete all copies in your possession or control.

10. Open source components and trademarks

The App may bundle third-party open-source libraries. Their respective licenses are listed in the About → Open Source Acknowledgments window inside the App. Nothing in these Terms restricts your rights under those open-source licenses.

Apache Kafka® is a registered trademark of the Apache Software Foundation. Confluent® is a registered trademark of Confluent, Inc. SwiftyKafka is an independent client and is not affiliated with, endorsed by, or sponsored by either organisation.

11. Governing law

These Terms are governed by the laws of the People's Republic of China, without regard to its conflict-of-laws principles. Any dispute arising out of these Terms shall be resolved in the competent courts of Hangzhou.

12. Changes

We may update these Terms from time to time. The current version will always be available at our website. Material changes will be highlighted in the App's release notes. Your continued use of the App after a change becomes effective constitutes your acceptance of the new Terms.
